1. About ThriftAI

ThriftAI provides an AI-powered scanning and valuation service for resellers and thrift shoppers. Our service uses artificial intelligence to analyze images of items and provide estimated resale values, market comparisons, and other insights.

2. Account Registration

• •You must be at least 16 years old to use ThriftAI.
• •You are responsible for maintaining the confidentiality of your account credentials.
• •You agree to provide accurate and complete information when creating your account.
• •You are responsible for all activity that occurs under your account.

3. Subscriptions and Payments

ThriftAI offers both free and paid subscription plans. Paid subscriptions are billed on a recurring basis through the Apple App Store or Google Play Store.

• •Subscription fees are charged in advance on a weekly, monthly, or annual basis depending on the plan you select.
• •You may cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of the current billing period.
• •Refunds are handled in accordance with the policies of the Apple App Store or Google Play Store.
• •We reserve the right to change subscription pricing with reasonable notice.

4. Scan Usage and Fair Use Policy

4.1 Scan Limits

To ensure service quality and availability for all users, ThriftAI applies reasonable usage limits on scans. These limits are applied on a daily, weekly, and monthly basis and vary depending on your subscription plan.

These limits represent the standard fair use thresholds and may be adjusted from time to time. Current limits are always displayed within the app.

4.2 Power User Plan

Subscribers on the Power User plan receive significantly higher or no enforced scan limits, intended for high-volume resellers with legitimate personal or business use. Even on the Power User plan, usage must remain consistent with normal human usage patterns and must not involve automated, scripted, or bot-driven scanning.

4.3 What Fair Use Means

Fair use means using ThriftAI scans for your own personal or small-business reselling purposes in a manner consistent with how the app is designed to be used. The following are examples of usage that falls outside fair use:

• •Using automated tools, bots, scripts, or third-party software to submit scans.
• •Sharing a single account among multiple users to circumvent limits.
• •Systematically scraping, extracting, or redistributing data obtained from scans.
• •Creating multiple accounts to bypass scan limits.
• •Reselling or commercially redistributing ThriftAI scan data to third parties.

4.4 Enforcement

If we determine that your usage exceeds fair use or violates these terms, we may, at our discretion: (a) notify you and request that you reduce usage; (b) temporarily restrict your scan access; (c) require you to upgrade to a higher-tier plan; or (d) suspend or terminate your account. We will make reasonable efforts to contact you before taking action, except in cases of clear abuse.

5. Acceptable Use

You agree not to:

• •Use ThriftAI for any illegal purpose or in violation of any applicable laws.
• •Upload images that contain illegal, offensive, or infringing content.
• •Attempt to reverse engineer, decompile, or disassemble any part of ThriftAI.
• •Interfere with or disrupt the service or servers or networks connected to the service.
• •Access the service through any automated means (bots, scrapers, etc.) without prior written permission.

7. Intellectual Property

• •ThriftAI and its original content, features, and functionality are owned by Smallstack ApS and are protected by intellectual property laws.
• •You retain ownership of images you upload. By uploading images, you grant ThriftAI a limited license to process and analyze them for the purpose of providing the service.
• •Anonymized and aggregated data derived from your scans may be used to improve our AI models and services.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Smallstack ApS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from: (a) your use of or inability to use the service; (b) any errors or inaccuracies in AI-generated valuations; (c) any unauthorized access to or use of our servers and/or any personal information stored therein; (d) any interruption or cessation of the service.

9. Service Availability

We strive to maintain high availability of ThriftAI but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

10. Account Termination

• •You may delete your account at any time through the app settings.
• •We may suspend or terminate your account if you violate these Terms of Service, including the Fair Use Policy.
• •Upon termination, your right to use the service will immediately cease. Data associated with your account will be handled in accordance with our Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Denmark.

12. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by email or through the app. Your continued use of ThriftAI after changes become effective constitutes your acceptance of the revised terms. If you do not agree with the updated terms, you should discontinue use of the service.
